At its heart was a man who claimed to be Sir Roger Tichborne, the missing heir to a baronetcy, despite overwhelming evidence to the contrary. This remarkable legal battle captivated the British public for over a decade, exposing not only personal deception but also deep societal fissures between class, wealth, and justice.

Background of the Case

The saga began with the disappearance of Sir Roger Tichborne, the presumed heir to the vast Tichborne estate in Hampshire, England. Born in 1829 into an aristocratic Roman Catholic family, Roger had a troubled relationship with his conservative family. In 1854, while traveling to Jamaica, his ship, the Bella, was reported lost at sea. He was presumed dead, and his death was accepted by the family; but not by his mother, Lady Henriette Tichborne, who believed her son had survived.

In 1865, an advertisement placed in Australian newspapers by the family’s lawyer (on Lady Tichborne’s insistence) led to a man in Wagga Wagga, Australia, stepping forward. This man claimed he was Roger Tichborne, now going by the name Thomas Castro.

Despite the fact that this man was obese, unrefined, and spoke with an Australian accent;  quite different from the slim, French-speaking aristocrat Roger once was; Lady Tichborne accepted him as her son.

Strategies Used by the Claimant

The Claimant, later identified as Arthur Orton, a London-born butcher’s son, used several strategic elements to gain credibility:

1. Emotional Manipulation of Lady Tichborne

Lady Tichborne was desperate to believe her son was alive. Orton (as Castro) gave just enough vague but convincing details to emotionally manipulate her into accepting his claim.

2. Tapping into Public Sympathy

The Claimant cleverly cultivated public support, especially among the working classes. Many people saw him as a working-class man fighting against the privileged aristocracy and the legal system.

3. Use of Witnesses

Despite the lack of resemblance, some witnesses (especially from Australia) vouched for the Claimant’s identity. He exploited the limited documentation and communication of the era to bolster his story.

4. Political Rhetoric

The case became politicized. Some radicals and republicans championed his cause, framing it as a class struggle between the common man and the elite establishment.

5. Legal Maneuvering

The Claimant launched a civil case in 1871 to claim the Tichborne inheritance. When it failed, the government prosecuted him for perjury in 1873, resulting in the longest trial in English legal history at the time.

While no exact monetary value can be attributed, the potential fraud was immense:

·         The Tichborne estate was worth £20,000 to £25,000 per annum at the time (equivalent to millions today).

·         The Claimant attempted to fraudulently acquire land, title, and wealth under a false identity.

·         Legal costs ran into tens of thousands of pounds. The government spent a considerable sum during the perjury trial.

The fraud was meticulously planned. Arthur Orton likely studied the Tichborne family and took advantage of the limited global communication and lack of photographic evidence to impersonate Roger.
